What is "Bankruptcy Remote"?
If Kernax Asset Architecture (the software company) were to ever face liquidation, bankruptcy, or dissolution, your assets remain untouched. Because the physical gemstones are legally titled to the independent Heritage Gemstone Preservation Trust, creditors of the software company have absolutely no legal claim over your vaulted assets.
Beneficial Ownership Rights
The Trust holds the "Legal Title" of the assets, but you hold the "Beneficial Title." The smart contract on the Polygon ledger acts as the immutable registry of beneficial owners. The Trustees are legally mandated to execute your instructions—whether that involves trading fractions or triggering a "Burn-to-Wear" physical redemption.
Custody & Specie Insurance
Assets are physically secured in high-security, climate-controlled vaults within the GIFT City Special Economic Zone (SEZ), operated by internationally recognized custodians (e.g., Malca-Amit). All Trust assets carry comprehensive "Specie Insurance" policies underwritten by Lloyd's of London, covering theft, loss, or damage.
The Trustee's Mandate
Appointed Compliance Trustees (including the Lead Trustee, Jamshid Abdul Karim) perform monthly statutory audits. They physically and cryptographically verify that the circulating supply of digital fractions perfectly matches the physical carats held in the vault (Proof of Reserve), publishing Schedule III compliance reports directly to your dashboard.
